Welcome to Opineko! These Terms of Service ("Terms") govern your access to and use of the Opineko website at https://opineko.com (the "Website") and our review management platform (the "Service"). By using our Service, you agree to these Terms.

1. Description of Service

Opineko provides a customer feedback and review management platform that enables businesses to:

  • Collect customer feedback through customizable review pages
  • Generate QR codes that link to review collection pages
  • Route satisfied customers to third-party review platforms (Google, TripAdvisor, Yelp, Facebook, Trustpilot, etc.)
  • Capture private feedback from unsatisfied customers
  • Receive notifications about new reviews via Telegram (Premier plan)
  • View analytics and export review data

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3. Subscription Plans and Payment

Opineko offers paid subscription plans. By subscribing, you agree to:

  • Pay all fees associated with your chosen plan
  • Provide valid payment information
  • Accept automatic renewal unless you cancel before the renewal date

Refund Policy: If you are unsatisfied with the Service, you may request a full refund within 7 days of your initial purchase. Refunds are not available after the 7-day period or for renewal charges.

4. Acceptable Use

You agree NOT to use the Service to:

  • Generate fake, fraudulent, or misleading reviews
  • Incentivize or coerce customers to leave reviews in violation of third-party platform policies
  • Collect reviews for businesses you do not own or have authorization to represent
  • Harvest personal data from customers for purposes unrelated to feedback collection
  • Send spam or unsolicited communications
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to circumvent, disable, or interfere with security features of the Service
  • Use the Service in any manner that could damage, disable, or impair our infrastructure

5. Third-Party Review Platforms

The Service integrates with third-party review platforms (Google, TripAdvisor, Yelp, Facebook, Trustpilot, etc.). You acknowledge that:

  • We do not control these platforms and are not responsible for their policies, availability, or content
  • You are responsible for complying with each platform's terms of service and review policies
  • Review links may change or become unavailable due to third-party platform changes
  • We do not guarantee that reviews will be published on third-party platforms

6. Customer Data and Reviews

You retain ownership of all customer feedback and review data collected through your Opineko account. By using the Service, you grant us a limited license to store, process, and display this data solely to provide the Service to you.

You are responsible for obtaining any necessary consents from your customers before collecting their feedback and for complying with applicable data protection laws.

7. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned byOpineko and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written consent.

You may use our QR codes and review page links for their intended purpose of collecting customer feedback.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Reviews collected will result in improved ratings on third-party platforms
  • Third-party platform integrations will always function as expected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPINEKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, third parties, or our business.

Upon termination, your right to use the Service will immediately cease. You may export your data before termination. We may retain certain data as required by law or for legitimate business purposes.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
